The appellate court has granted three lawsuits filed by the Nemishlyansk District Prosecutor's Office of Kharkiv, declaring the land lease agreements invalid and ordering the return of land plots totaling over 3 hectares, valued at nearly 180 million UAH.

This information was reported by the Kharkiv Regional Prosecutor's Office, as stated by "Dumka".

According to the prosecutor's office, in 2020, the Kharkiv City Council decided to lease three land plots on Olympic Street and Petro Hryhorenko Avenue to a company. The company was supposed to construct a multi-apartment residential building along with commercial and market infrastructure. The value of the plots is approximately 180 million UAH.

"However, the aforementioned decisions of the local self-government authority do not comply with legal requirements. According to the norms of the Land Code of Ukraine and the Law of Ukraine 'On Land Lease', the leasing of land plots in communal ownership must occur following land auctions. Since these auctions were not conducted, the lease agreements were concluded unlawfully," the prosecutor's office emphasized.

The prosecutor's office filed three relevant lawsuits in the Economic Court of Kharkiv Oblast, which were initially dismissed. The prosecutors appealed these decisions in an appellate manner. The Eastern Appellate Economic Court upheld the lawsuits.
