The Kharkiv Regional Prosecutor's Office has returned property worth 1.5 million UAH to the state.
This information was reported by the Kharkiv Regional Prosecutor's Office, as conveyed by "Dumka".
According to the prosecutor's office, this pertains to the return of unlawfully transferred property to state ownership - a two-story non-residential building with an area of over 500 m², located on Mala Hontarivska Street in Kharkiv. It has been established that in 2020, the state registrar of the Krysyne Village Council in the Bohodukhiv district of Kharkiv region registered the right of private ownership for the specified building based on an application from an individual.
"To confirm his ownership, the individual provided a sales contract and an acceptance certificate for the non-residential building, dated back to 2002, claiming that he purchased the building as the winner of an auction. The seller of the building in the auction protocol was also identified as the corresponding individual, who did not actually own the building. According to the auction information, documents regarding the relevant auction are missing," the statement reads.
At the same time, according to existing documents, the legitimate owner of the administrative building on Mala Hontarivska Street is the state, represented by the Ministry of Culture and Strategic Communications of Ukraine, while the balance holder is the State Artistic and Creative Production Enterprise, which falls under the management of the Ministry. The man, in whose name the property was illegally registered, passed away in 2021, and there were no heirs after his death.
To restore interests and protect the rights of the state, the prosecutor's office has filed a lawsuit to recognize the state’s ownership of the specified building. The Economic Court of the Kharkiv Region supported the prosecutor's office's position and granted the claim. The court's decision has been effectively implemented - the ownership of the building has been registered in the State Register of Real Rights to Immovable Property in favor of the state.
